The following are the terms and conditions for use of the Services. By clicking the "I accept these terms and conditions" button on the registration page or by logging in to JobBankCanada.com, you accept these terms and conditions.

Acknowledgements - Subject in each case to the terms listed in the remainder of this Agreement, you hereby acknowledge and agree that:

JobBankCanada.com may only be used for lawful purposes. Any and all text and images you post on JobBankCanada.com or enter into its databases will be lawful by Canadian standards and suitable to a general audience.

JobBankCanada.com is not responsible for the content of linked sites or any possible harm caused by a linked site.

Images hosted by JobBankCanada.com should be backed up for your files. JobBankCanada.com will not be held not responsible should an image or images disappear.

The Services will be subject to yearly (or monthly if applicable) subscription fees. No fees will be applicable to any free trial period.

JobBankCanada.com has the right to make modifications to your information, listing and profile pages if required for visual, quality control or optimization purposes at its discretion. JobBankCanada.com will attempt to consult with you about any such modifications.

JobBankCanada.com is not responsible for data obtained illegally or fraudulently.

Your listing and profile information will only be activated after it has been reviewed by a human for quality control purposes.

Information you submit and the results achieve by using JobBankCanada.com’s services may be used by JobBankCanada.com for promotional purposes.

You agree to Opt-in to receive at least one of our monthly newsletters. All of our newsletters contain an automated Opt-out feature. You are welcome to Opt-out at any time to discontinue receiving our newsletters.

JobBankCanada.com is not responsible for damages of any kind no matter how damages may be caused.

Privacy - All parties to this agreement shall abide by the "Privacy Policy" listed on the JobBankCanada.com website.

Termination - You may terminate this Agreement at any time by calling JobBankCanada.com 604-628-2495. There are no refunds for any fees paid.

JobBankCanada.com may terminate this Agreement or the Services, disable your account or put your account on inactive status, in each case at any time with or without cause, and with or without notice. JobBankCanada.com shall have no liability to you or any third party because of such termination or action.

JobBankCanada.com may delete any of your archived data within 10 days after the date of termination or trial end.

All sections of this Agreement that by their nature should survive termination will survive termination, including, without limitation, ownership, warranty disclaimers and limitations of liability.

JobBankCanada.com has the right to change any and all terms and conditions without notice. If changed and an issue arises the terms agreed to at the time of of the last agreement will apply. The client will be responsible for providing an original copy of such terms or the most recent terms may apply at JobBankCanada.com's sole discretion.

Your sole and exclusive remedy for any failure or non-performance of the Services shall be for JobBankCanada.com to use commercially reasonable efforts to adjust or repair the Services.

USE OF THE SERVICES AND ANY RELIANCE BY YOU UPON THE SERVICES, INCLUDING ANY ACTION TAKEN BY YOU BECAUSE OF SUCH USE OR RELIANCE, IS AT YOUR SOLE RISK. JobBankCanada.com DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES IT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES UNLESS SPECIFICALLY AGREED TO IN WRITTING. THE SERVICES ARE PROVIDED "AS IS" AND JobBankCanada.com DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

Limitation of Liability - TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL JobBankCanada.com OR ANY OF ITS UNDERLYING SERVICE PROVIDERS, BUSINESS PARTNERS, INFORMATION PROVIDERS, ACCOUNT PROVIDERS, LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES, DISTRIBUTORS OR AGENTS (COLLECTIVELY REFERRED TO FOR PURPOSES OF THIS SECTION AS "JobBankCanada.com ") BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY MONEY DAMAGES, WHETHER DIRECT, INDIRECT, SPECIAL, INCIDENTAL, COVER, RELIANCE OR CONSEQUENTIAL DAMAGES, EVEN IF JobBankCanada.com SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. IN THE EVENT THAT NOTWITHSTANDING THE FOREGOING, JobBankCanada.com IS FOUND LIABLE TO YOU FOR DAMAGES FROM ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE), THE LIABILITY OF JobBankCanada.com TO YOU WILL BE LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES.

Miscellaneous - No agency, partnership, joint venture, or employment is created as a result of the Agreement, and you do not have any authority of any kind to bind JobBankCanada.com in any respect whatsoever.

In any action or proceeding to enforce rights under the Agreement, the prevailing party will be entitled to recover its costs and attorneys' fees.

The Agreement shall be governed by the laws of the Province of British Columbia, Canada without regard to its choice or law or conflict of laws provisions. All legal actions in connection with the Agreement shall be brought in the Province of British Columbia.

The Services are available only to persons who can form legally binding contracts under applicable law. Without limiting the foregoing, the Services are not available to individuals under the age of 18. If you do not qualify, you are not permitted to use the Services.
